7. Our Lawful Bases for Processing

We process personal information only where we have a lawful basis.

Legitimate interests

We may process information where it is necessary for our legitimate interests or those of another party, provided those interests do not override your rights.

These interests may include:

  • operating a professional recruitment business;
  • finding and assessing suitable candidates;
  • helping candidates access relevant opportunities;
  • introducing candidates to potential employers;
  • developing relationships with employers and business contacts;
  • managing and improving our services;
  • protecting our business, systems and legal rights; and
  • communicating with professional business contacts.

Contract and pre-contractual steps

We may process information where it is necessary to:

  • take steps at your request before entering into an agreement;
  • provide recruitment services;
  • enter into or perform a client contract; or
  • manage our contractual relationship with you or your organisation.

Legal obligations

We may process information to comply with obligations relating to:

  • taxation and accounting;
  • fraud prevention;
  • regulatory requirements;
  • legal proceedings;
  • right-to-work requirements where applicable; or
  • lawful requests from courts, regulators or public authorities.

Consent

Where consent is the appropriate lawful basis, you may withdraw it at any time. Withdrawing consent will not make any processing carried out before withdrawal unlawful.

Legal claims and employment-related conditions

Where we process sensitive personal information, we will also identify an appropriate additional condition. This may include employment and social-protection law, establishing or defending legal claims, substantial public interest or explicit consent where appropriate.

8. Sharing Your Personal Information

We may share relevant information with:

  • prospective and existing employers;

  • parties involved in a potential sale, restructuring or transfer of our business.

We only share information that is reasonably necessary for the relevant purpose.

Employers receiving candidate information will generally process that information as independent data controllers and should provide their own privacy information.

MagGuney Ltd does not sell personal information.

9. International Data Transfers

Some service providers we use may process or store information outside the United Kingdom.

Where personal information is transferred internationally, we will take appropriate steps to protect it. These may include:

  • transferring information to a country covered by UK adequacy regulations;
  • using approved contractual safeguards;
  • completing appropriate transfer-risk assessments; or
  • relying on another lawful transfer mechanism.

10. How Long We Keep Personal Information

We retain personal information only for as long as it is reasonably required for the purpose for which it was collected, including legal, accounting and reporting requirements.

Our usual retention approach is:

Candidate records

Candidate profiles, CVs and recruitment communications may normally be retained for up to 24 months after our last meaningful contact or recruitment activity.

We may contact you before or during this period to confirm whether your details remain accurate and whether you wish to continue receiving recruitment support.

Information may be retained longer where:

  • you remain actively engaged with us;
  • you ask us to retain it;
  • we have an ongoing legitimate business reason;
  • it relates to a placement or active recruitment process; or
  • retention is required for legal or regulatory purposes.

Vetting and verification information

Copies of documents collected for checks will be deleted when they are no longer necessary. We may retain a record that a check was completed and its outcome where appropriate.

Client and financial records

Client agreements, invoices, payment records and related business information may generally be retained for up to six years, or longer where required by law or in connection with a legal claim.

General enquiries

Information relating to general enquiries may usually be retained for up to 12 months after the enquiry has been resolved.

Marketing information

Marketing preferences may be retained until you unsubscribe or object. We may keep limited information on a suppression list to ensure that we respect your request not to receive further marketing.

At the end of the applicable retention period, information will be securely deleted, destroyed or anonymised.

11. Keeping Your Information Secure

We use appropriate technical and organisational measures designed to protect personal information against:

  • unauthorised access;
  • accidental loss;
  • misuse;
  • alteration;
  • disclosure; and
  • destruction.

Access to personal information is restricted to individuals and service providers who require it for legitimate business purposes. Those parties are expected to handle the information securely and confidentially.

12. Recruitment Decisions and Automated Processing

MagGuney Ltd does not currently make recruitment decisions based solely on automated processing where the decision would have a legal or similarly significant effect on an individual.

Technology may be used to help organise information, search candidate records or identify potential matches. However, recruitment decisions and candidate recommendations involve human review.

We will update this policy and provide any additional information required by law if this approach changes.

13. Marketing and Vacancy Communications

We may send:

  • vacancy alerts;
  • recruitment updates;
  • information about our services; or
  • relevant professional communications.

We will do so only where permitted by data protection and electronic-marketing rules.

You can unsubscribe at any time by:

  • using the unsubscribe option in the communication; or
  • contacting us at contact@magguney.co.uk

Service messages relating to an active application, recruitment assignment, agreement or enquiry are not marketing communications.

  • operate essential website functions;
  • remember user preferences;
  • protect website security;
  • understand how visitors use the website; and

We may ask for information to verify your identity. We will normally respond without undue delay and within one month, subject to any lawful extension.
