  • an agreement to introduce a particular candidate;
  • an employer’s instruction to recruit;
  • or MagGuney Ltd’s Terms of Business with a client.

Recruitment services provided to employers may be governed by separate written Terms of Business.

Candidates may also receive separate information or terms relating to our work-finding services and the processing of their application.

Where separate written terms apply, those terms will take priority in relation to the relevant recruitment service or assignment.


5. Access to the Website

We aim to keep our website available and operating correctly. However, we do not guarantee that:

  • the website will always be available;
  • access will be uninterrupted;
  • the website will be free from faults or errors;
  • all features will be available at all times; or
  • website content will always be current.

  • your qualifications, experience and employment history are represented honestly;
  • you will notify us of any material change affecting your application;

  • you will cooperate with reasonable verification checks relevant to a position.

You remain responsible for reviewing and approving the accuracy of information contained in your CV and application.

We may request additional information to assess your suitability or meet legal and regulatory obligations.

We may decide not to progress an application where:

  • the candidate does not meet the essential requirements of the position;
  • information is incomplete, inaccurate or misleading;
  • required documents are not provided;
  • necessary checks cannot be completed;
  • the vacancy has been withdrawn or filled; or
  • progressing the application would be unlawful or inappropriate.

Submitting an application does not create an employment, worker, agency or contractual relationship between you and MagGuney Ltd.

Unless expressly agreed otherwise, MagGuney Ltd does not employ candidates introduced for permanent employment. Any successful candidate will normally enter into an employment relationship directly with the hiring organisation.


8. Candidate References and Checks

Where relevant to a position, we may request or assist with:

  • employment references;
  • qualification checks;
  • professional registration checks;
  • identity checks;
  • right-to-work information;
  • regulatory checks; or
  • other proportionate screening.

Candidates must provide accurate referee information and must not provide another person’s details without an appropriate reason or permission.

The nature and extent of checks will depend on the role, the employer’s requirements and applicable law.

An employer may carry out its own checks independently of MagGuney Ltd.

9. Candidate Fees

MagGuney Ltd does not charge candidates a fee for finding or attempting to find them permanent employment.

Employers may pay MagGuney Ltd a recruitment fee under separate contractual Terms of Business.

No website content should be interpreted as requiring a candidate to purchase a service in order to be considered for employment.


10. Information for Employers

Information published on our website about recruitment services is general and does not constitute a binding quotation, contractual offer or guarantee.

Before we begin a recruitment assignment, we may require the employer to:

  • provide complete and accurate vacancy information;
  • identify essential qualifications or legal requirements;
  • explain the proposed duties and working conditions;
  • disclose known health and safety risks relevant to the role;
  • provide information about remuneration and benefits;
  • confirm its authority to recruit;
  • accept our separate Terms of Business; and
  • provide any additional information reasonably required to conduct the search.

An employer must not provide vacancy information that is:

  • false or misleading;
  • discriminatory or otherwise unlawful;
  • unrelated to a genuine employment opportunity;
  • intended to obtain candidate information improperly; or
  • in breach of another person’s rights.

Recruitment fees, payment terms, candidate introductions, ownership periods, replacement provisions and any refund arrangements are governed only by MagGuney Ltd’s separate Terms of Business with the employer.


11. No Guarantee of Placement or Appointment

Although we aim to make suitable introductions, we cannot guarantee:

  • that a candidate will obtain employment;
  • that an employer will fill a vacancy;
  • that a candidate will accept an offer;
  • that an employer will proceed with an appointment;
  • the length or success of an employment relationship;
  • the performance of a candidate or employer; or
  • that either party will meet the other party’s expectations.

Candidates and employers remain responsible for making their own final decisions.

Employers are responsible for assessing candidate suitability and carrying out any checks required for the position.

Candidates are responsible for deciding whether an employer, vacancy and offer are suitable for them.


12. Accuracy of Website Content

We take reasonable steps to keep information on our website accurate and current. However, website content may occasionally:

  • contain errors or omissions;
  • become outdated;
  • differ from information subsequently supplied by an employer; or
  • require correction.

We may update, amend or remove website content at any time.
